Free Arkansas Rental Lease Forms

According to the Arkansas Code – Title 18, Chapter 16 it is required to have either a Fixed term lease or Month-to-Month lease agreement in the State of Arkansas. Usually the agreement starts as a fixed term and then renews according to the Month-to-Month rental lease according to the requirements and acceptance of both the landlord and the tenant.

The state of Arkansas has laws and regulations governing the landlord and the tenant. Both parties need to familiarize themselves with restrictions and responsibilities as laid out under Ark. Code Ann. § 18-16 and Ark and Code Ann. § 18-17.

Overview of the Arkansas Landlord and Tenants Law

Security deposit and return policy

The landlords who own five or fewer dwellings are exempted from the deposit statutes as stated under A.C.A. §18-16-30. The landlord should also ask for a deposit of not more than two month’s rent according to A.C.A. § 18-16-304.

Section A.C.A. § 18-16-305 requires the landlord to return the deposit within 60 days after the tenant vacates the premises.

Required disclosure and return policy

The disclosure explains the responsibilities of both the parties; the landlord and the tenant. Some of the things a tenant should comply with as stated under A.C.A. § 18-17-601include dealing with trash, appliances, keeping clean premises, plumbing, and quiet enjoyment.

When handling the written lease, the landlord is supposed to disclose any lead-based paints and hazards. According to A.C.A. § 18-16-112(b), victims of domestic violence are well protected especially from eviction. The landlord is also mandated to have locks changed if the tenant requests the same.

Late fees and other rent rules

The rent should be paid on time as agreed by both parties and a grace period of five days given as well as stated in A.C.A. §18-17-401 and A.C.A. § 18-17-701(b) respectively. If the landlord fails to provide essential services, the tenant is allowed to withhold the rent.

Termination and eviction rules

The termination and eviction rules depend on the tenancy period. The week to week lease requires seven days’ notice while the month to month required 30 days’ notice according to A.C.A. § 18-17-704.

In cases where there is a violation or other issues stated as stated under A.C.A. § 18-60-304, the landlord can terminate the tenancy immediately.

Tenants need to understand that they are supposed to take the property as it is and the landlord is not responsible for any repairs unless there is an agreement. Understanding the state laws by both parties is fundamental as it creates a foundation for an effective and hassle-free tenancy period.
