A landlord of a residential property requires New York Residential Lease Agreement while leasing a residential property to a tenant. This template adheres to the New York State Law Article 7 > 220:238. This document has 36 sections comprising of the terms and conditions of the tenancy for the tenant as well as the landlord and it is legally binding on both parties upon signing and execution. In addition, the landlord must ensure compliance with the requirements of Lead-Based Paint Disclosure for pre 1978 housing. Both parties must come together while preparing the agreement once the landlord approves tenant’s credit review upon submission of the Rental Application Form. How to Write New York Residential Lease Agreement

  • Begin by entering the date of execution of the lease agreement in the requested format.
  • Enter name of the landlord and the tenant on the respective lines.
  • Enter name of the county in section 1. Then enter the property address followed by the description of the items on the personal property.
  • Enter name of the proposed occupants in the property in section 2.
  • Enter lease commencing and termination dates in section 3.
  • Enter the security deposit amount in section 4.
  • Section 5, Rent Payments requires information about the amount of monthly rent installment, date of paying the first installment, date for paying delayed rent, and amount of late charge in case of default. Continue by entering the amount of prorated rent, select mode of payment, and provide information about the name and address of the landlord. You as a tenant can select one mode of remittance from available options like cash, money order, personal check, cashier’s check, or any other mode suitable and mutually agreed with the landlord.
  • Make the selection of the payment responsibility between the tenant and landlord for the utilities like Electric, Cable TV, Gas, Water, Phone, and Garbage Pickup in section 8.
  • Please enter the address of the landlord to send notices and frequency of tenant’s absence from the property in section 21. These notices may include detailed information about the frequency and duration of tenant’s absence.
  • Section 35, Lead-based Paint Disclosure requires the landlord to make a selection of one choice. Such declaration is mandatory by the law. The landlord must declare that the property is constructed on or after 1978 or the landlord gives the Lead-based Paint Disclosure Form along with the EPA pamphlet to the tenant for complying with federal requirements.
  • Provide information about additional provisions, if any in space reserved in section 36.
  • The landlord must sign this lease agreement after entering the date and print name.
  • Each tenant must sign the agreement on a separate line after entering date and print name to complete preparation of New York Residential Lease Agreement in its entirety.
